Hi.
My Wife is currently in H4 Visa and in US now. She has total of 11 years IT experience. She lastly worked with a Company X from May 2004 to May 2008 for about 4 years. Currently she is not an employee of Company X and also not working anywhere.
If the same Company X gives an US offer, Is it possible for the Company X to file L1 visa for her so that she can start working for that company immediately ? ( I have read in immigration forums that the L1 Visa Eligibility is that the person should have worked for that company for atleast 1 year within the last 3 years)
Experts, Can you pls give your opinion and suggestion on this ? If so, how long the process takes place for transfering from H4 to L1 visa ?

If it has been more than 90 days for the EAD renewal application and the EAD is about to expire, what can one do? I know they no longer give walk-in EADs. I have tried to contact them but no positive response. Any help would be appreciated.

H-1B employers need to be aware that June 30, 2009 will be the last day that the Department of Labor�s LCA Online system will be operational. As of July 1, 2009, all LCAs for H-1B and E-3 cases will need to be submitted through the iCERT portal (http://icert.doleta.gov/) and that means the end of instant LCA certifications.
This has very important implications for the timing of H-1B and E-3 applications as they relate to new hires and extensions. Employers will need to allow for delays in LCA certifications of at least 7 days rather than the instant certifications that were previously issued.

Hello All,
My I-140 was approved on 10/08/2008. But I am not sure if it is EB2 or EB3.
My labor was filed with MS + 2years but My I-140 Notice Type says:
Skilled Worker or Professinal, Sec 203(b) (3) (A) (i) or (ii).
I will appreciate any feedback.

All I know is I went for Special Registeration back in 2003 when it initially started and citizens of specific countries were required to go for that special registeration. The immigration officer stamped my I-94 and wrote a FIN# on my passport and I-94.
Last time I travelled out of US was back in May 2001 for couple of weeks.
Now got this RFE any idea what do I need to submit.

This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). I have married my wife last friday. we have been living together for almost two years and own a home together for 6 months. I have been in the stats on A2 visa up until now (3.5 years). I have the doctor's letter on hand and I want to apply for my adjustment of status by early next week. I was told that I will ( MUST LIKELY) receive my I-131 travel document approved in no earlier than 3 months from the time of filling. I have bought tickets to go with my wife to New-Zealand for our best friends wedding on november 5th which means I won't have the travel document on hand in time.
What can I do?

I am Aug 07 filer , I was not able to submit my medicals with my I-485 application .
I got my medicals done with civil surgeon in sept 2007 and was waiting for RFE to submit the sealed cover . I never got a RFE but I got a interview at local office next month .
So can I submit the sealed cover that the civil surgeon filled in 2007 or do I need to get all the tests done again now and fill a new form .

Hi:
After at least 3 - 4 calls, over the last month, I finally spoke to IO at NSC. And she took my LIN numbers(other IOs did not even bothered). And then after 1 minute she replied that..my case is waiting to be assigned to Officer.
I even got my I140 checked but she was patient and told my HR that whole cas e is waitng to be assigned to Officer.
Is this something to be looking forward to or is it a usual reply?
Did anyone get this kind of reply?

I am not sure if its a new rule to get an NOC from the husband, but as far as i know NOC is required only for Govt Employees. Make sure you really need one for getting a passport for an individual. If your wife is a Govt Employee then she may need one from the Govt/Office where she works.
